It is no secret
that our firm has many disagreements with USDA/APHIS, the entity that
regulates the zoo industry as well as other related activities. While
we have been in several disagreements with the USDA for the last 7
years, our policy is to always conduct ourselves in the utmost professional
manner. This is one of the many reasons that we choose not to get
involved in the "trial by media" aspects of such propaganda and proceedings.
The USDA/APHIS inspectors and attorneys have been found and/or accused
of many wrong doings such an example in the Decision as to James G.
Zajicek, AWA Docket No. 03-0023,to where:
-USDA-APHIS inspectors fail
to comply with their own rules and guidelines,
-USDA-APHIS inspectors
failing to notify the inspected party of possible violations so that
appropriate, timely corrective action may be taken,
-Failure to disclose
potentially exculpatory evidence in a timely manner,
-The obdurate
resistance to subpoenas issued by a Judge, and the possible destruction
of evidence, (to wit quoting) Chief Administrative Judge Marc Hillson:
"I found many aspects of Complainant’s (USDA/APHIS) conduct throughout
this case to be troubling and of concern", and further withholding
evidence under subpoenas, as well as other actions.
Our firm
is not the only one that has had, and is having to be subjected to
this.
Our management has over 23 years experience of working
with such magnificent animals, and our veterinary staff carries with
it very high standards. Our veterinarians have respectively disagreed
with the USDA inspectors continuously. We are even happy to share
the past 20 veterinarian inspection reports from 4 different veterinarians,
combining over 130 years of experience, some are USDA accredited veterinarians,
all reporting above standards or superior conditions with our animals.
